Article 1
Acceptance of the terms: These terms apply for the entire period during which the services offered by sea-mop.com are available online. The customer acknowledges having read, at the time of placing the order, the general terms and conditions of sale set out on the sea-mop.com website. Any order placed constitutes acceptance of these general terms and conditions without any reservation. These general terms and conditions of sale govern the contractual relationship between Oz and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms contained in any other document, unless otherwise agreed in advance, expressly and in writing.
Article 2
Products: Photographs, texts, diagrams, drawings or videos illustrating the products do not form part of the contract. If errors that do not affect the essential characteristics of the product have been introduced, under no circumstances may the liability of Oz or sea-mop.com be incurred.
Article 3
Order / payment: Oz or sea-mop.com will inform you by email of any stock shortages or exceptional delays that may affect the order and, in such case, the product may be refunded according to the customer’s wishes. The Internet is the only ordering method we offer our customers. Automatic recording systems are considered proof of the content and date of the order. The sea-mop.com website only allows online electronic payments. For these online payments, the buyer accesses a secure SSL server and securely enters the details of their payment method. The secure payment solution implemented is Stripe or PayPal. Depending on the technical characteristics of the encryption software, the information provided by the buyer cannot be intercepted by a third party. The buyer agrees in advance and unconditionally that Oz or sea-mop.com will carry out the secure transaction. The buyer authorizes their bank in advance to debit their account upon presentation of the information or statements transmitted by Oz or sea-mop.com, even in the absence of an invoice signed by the cardholder. Authorization to debit the account is given for the total amount of the product purchased, including shipping costs. The order validated by the customer will only be considered effective once the relevant banking payment centers have given their approval. In the event of refusal by said centers, the order will be automatically cancelled. Oz or sea-mop.com reserves the right to cancel any order from a customer with whom there is a dispute relating to payment for a previous order. The information provided by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient’s contact details, the seller cannot be held responsible for any inability to deliver the product.
Article 4
Delivery: Delivery will be carried out by Oz or sea-mop.com, via one of the subcontracted carriers chosen by the customer at the time of ordering. Oz or sea-mop.com shall not be liable for delivery delays attributable to the carrier or to any other external event, fortuitous event or force majeure. The following are considered cases of force majeure relieving the seller of its obligation to deliver: war, riot, fire, strikes, severe weather, accidents and inability to obtain supplies. In the event of a stock shortage, Oz or sea-mop.com undertakes to provide information on each product and to notify the buyer by email if an order has already been placed by the latter. In the event of a delivery delay exceeding 15 days and not due to a case of force majeure, the customer may terminate the contract by registered letter with acknowledgement of receipt, or accept a new delivery time, without being able to demand a price reduction. It is the customer’s responsibility to always check the parcel upon arrival. Any reservations or claims must be sent by registered letter with acknowledgement of receipt to customer service within 2 days of receipt in order to submit any complaints. Failing such notification, the customer will be deemed to have accepted the delivery and all items comprising the order, and will no longer be entitled to take legal action on this basis against Oz. Likewise, late claims are not acceptable and prevent any subsequent recourse.
Article 5
Withdrawal: The customer has 14 days (from receipt of the items) to withdraw. In the event of a request for exchange or refund, the customer returns the new item in its original packaging, intact, accompanied by any accessories, user manual and documentation, and a copy of the delivery note to the following address: Oz, Talaria Center, Departement Mop, 7 rue de l’Industrie, 98000 Monaco, Principality of Monaco. After this period, the right of return no longer applies. Shipping and return costs shall be borne by the buyer unless the return of the parcel is due to a manufacturing defect. In the event the right of withdrawal is exercised, Oz or sea-mop.com is required to refund the sums paid by the customer, without charge, except for shipping and return costs. The refund is due within a maximum of 21 days. The customer authorizes in advance that the returned product will be subject to a thorough inspection before it is exchanged or refunded. If the product was damaged, the buyer could not be refunded.
Article 6
Price: For each item, the price indicated does not include shipping. In the order confirmation, the total amount is the final price, expressed inclusive of all taxes and including VAT where applicable. This price includes the price of the items, handling, packaging and storage costs, and shipping costs (see Article 4 – delivery).
Article 7
Disputes: This contract is governed by Monegasque law. Oz cannot be held liable for damage of any kind, whether material, immaterial or bodily, that may result from improper use of the products sold or from abnormal use.
Article 8
Warranty: In the event of a manufacturing defect in the product sold, the buyer benefits from the legal warranty against hidden defects as provided for in the Monegasque Civil Code. Exclusions: Products for which no defect is found upon unpacking, as confirmed after diagnosis by our services, or products that have been misused.
Any unjustified return will be charged to the customer: service fees and return shipping of the goods.
Article 9
IT and civil liberties: In accordance with applicable law, the processing of personal information relating to customers is subject to a declaration. The customer has the right to access, modify, rectify and delete data concerning them, which they may exercise with Oz by mail or by email at: crew@sea-mop.com. This email address is protected against spam bots. Personal data is protected by law and is not used by third parties: the customer may only receive commercial emails if they have requested them. At any time, the customer may update their details directly on sea-mop.com. All such data may be modified by the customer. The customer is entitled to request deletion from Oz’s customer file. This information makes it easier for the customer to use the Oz website, for example by avoiding multiple re-entries, and to fully benefit from all the features the website offers. The customer’s address is useful at the time of ordering in order to send the invoice and the order within the required timeframes. The customer’s telephone details enable Oz to contact the customer for order tracking. The customer’s email address enables Oz to confirm the customer’s orders. The customer’s banking information (card number, expiry date) is encrypted by the SSL system. It is inaccessible to any third party and is in no case held or recorded by Oz or sea-mop.com.
Article 10
Evidence: The electronic records kept by Oz or sea-mop.com constitute evidence of the parties’ contractual obligations. The buyer may provide evidence to the contrary of the claims made by Oz or sea-mop.com. If an amicable settlement fails, any dispute relating to the interpretation or performance of the contract shall fall within the jurisdiction of the courts of the Principality of Monaco.
Article 11
Amendments: Oz or sea-mop.com reserves the right to adapt or amend these General Terms and Conditions of Sale at any time, which will be immediately brought to the buyer’s attention via an online update.
